Questions about when it is right for police forces to investigate alleged offences committed in the more or less distant past have become increasingly pressing. Recent widely publicized cases of child sexual abuse (CSA) and exploitation, sometimes involving high profile individuals, have illustrated the ethical, psychological, and forensic complexities of investigating non-recent child sexual abuse. Hannah Maslen and Colin Paine have developed the Oxford CSA Framework to assist police to weigh the various ethical considerations that militate for and against initiating (...) a CSA investigation. While such a tool is to be welcomed, and while there is much that is helpful in Maslen and Paine's approach, we suggest that the Oxford CSA framework could be strengthened. Our first suggestion is to abandon a proposed distinction between a set of considerations that is said to generate a “presumption” in favor of investigation and other considerations that may supplement or oppose this presumption. Our second suggestion is to review the weightings applied to the considerations within the model, which lack clear justification and create problematic effects. Finally, we suggest that referring the Oxford CSA Framework to a panel with lived and professional experience of CSA could serve important procedural justice goals and enhance the Framework's recommendations. Advances in forensic techniques have expanded the temporal horizon of criminal investigations, facilitating investigation of historic crimes that would previously have been considered unsolvable. Public enthusiasm for pursuing historic crimes is exemplified by recent high-profile trials of celebrities accused of historic sexual offences. These circumstances give new urgency to the question of how we should decide which historic offences to investigate. A satisfactory answer must take into account the ways in which the passage of time can erode the benefits of (...) criminal investigation, the costs associated with investigating old crimes, and the need to prioritize investigations in the face of limited police resources. This article emphasizes the first of these factors. It begins by considering the moral goals of a criminal justice system and the contribution of criminal investigations to the achievement of these goals, distinguishing between contributions that depend on further steps in the criminal justice process, such as prosecution and punishment, and contributions that can have value independently of these further steps. Using this important distinction, the article then examines a range of factors that relate the passage of time to criminal justice goals, including the seriousness of the crime; deterioration of evidence; death of the offender, victim and others affected by the crime; and diminished psychological connectedness between those affected by the crime and their current selves. While the range and non-uniformity of relevant factors preclude a simple answer to the question of when historic crimes should be investigated and call instead for case-by-case assessment, we find that the analysis does support some general conclusions that can guide such an assessment. Modal dispositionalists hold that dispositions provide the foundation of metaphysical necessity and possibility. According to the kind of modal dispositionalism that can be found in the present literature, a proposition p is possible just in case some things are disposed to be such that p. In the first part of this paper I show that combining this classic form of dispositionalism with the assumptions that the laws of nature are necessary and deterministic and that all dispositions are forward-looking in time (...) leads to the unattractive conclusion that every truth is necessary. I argue that the classic dispositionalist should be troubled by this result and in the second part of the paper I suggest a novel variant of dispositionalism that avoids it. This extended form of dispositionalism allows that some propositions are only indirectly underwritten by dispositions. (shrink)

ObjectiveWhile nudges are increasingly utilized in public policy settings, their potential threat to autonomous choice is the topic of heated debate. Regardless of the actual effects of nudges on autonomy, the mere perception of nudges as autonomy threatening by the general public or policy makers could negatively influence nudge acceptability. The present online studies examined how people expect nudges to affect their perception of autonomy.MethodsIn the first study, participants were presented with a hypothetical choice that employed either a default nudge, (...) direct persuasion, or no persuasion, to steer to the desired choice. The presented influence technique was explained before participants reported their expected autonomy, as well as their expected choice satisfaction. Study 2 involved a replication of Study 1 with an additional social norm nudge condition. In Study 3, the explanation of how choice had been influenced was omitted.ResultsWhile participants expected the default nudge to violate autonomy, they had no such expectations for social norm nudges. Omitting the explanation that most people are unaware of nudges influencing their choice, reduced the negative impact of nudges on expected autonomy.ConclusionEffects of nudges on expectations of autonomy differ by type of nudge. Negative expectations are primarily driven by the explanation that decision makers are often unaware of nudges. (shrink)

This paper discusses a puzzle raised by Sharon Berry, published in Analysis. The question in the background of this puzzle is how we should deal with seemingly plausible possibility judgements that commit us to counterfactual truths that find no basis in reality. Three answers to this question and their corresponding solutions to the puzzle will be discussed. The last answer provides a way to make sense of the claim that it is in some cases indeterminate whether a proposition is possible (...) and offers an account of indeterminate modal status. (shrink)

The purpose of this essay is to analyze succinctly the concept of faith through the very penetrating gaze of the Danish philosopher Sören Kierkegaard. Faith is analyzed by Kierkegaard from absurdity, resignation and the paradox of faith. In the same way, his concept of faith is carved with a chisel that would complete all his philosophy, that is, to touch human reality away from any abstract thought, trying at all times that his examination be seen on a personal dimension in (...) his rigorously individual coret. Is the procreation asymmetry intuitively supported? According to a recent article in this journal, an experimental study suggests the opposite. Dean Spears (2020) claims that nearly three-quarters of participants report that there is a reason to create a person just because that person’s life would be happy. In reply, I argue that various confounding factors render the study internally invalid. More generally, I show how one might come to adopt the procreation asymmetry for the wrong reasons by misinterpreting one’s intuitions.

This paper offers a unified explanation for the procreation asymmetry and the non-identity thesis – two of the most intractable puzzles in population ethics. According to the procreation asymmetry, there are moral reasons not to create lives that are not worth living but no moral reasons to create lives that are worth living. I explain the procreation asymmetry by arguing that there are moral reasons to prevent the bad, but no moral reasons to promote the good. Various explanations for the (...) procreation asymmetry have failed to explain the non-identity thesis: if one could create a person with a good life or a different person with a better life, one has a moral reason to create the better life. I argue that reflections on the misfortune of unfulfilled potential allow us to circumvent the non-identity problem. (shrink)

The current situation around COVID-19 portrays a threat to us in several ways: It imposes uncertainty, a lack of control and reminds us of our own mortality. People around the world have reacted to these threats in seemingly unrelated ways: From stockpiling yeast and toilet paper to favoring nationalist ideas or endorsing conspiratorial beliefs. According to the General Process Model of Threat and Defense the confrontation with a threat - a discrepant experience - makes humans react with both proximal and (...) distal threat responses. While the proximal response manifests in behavioral inhibition that leads to heightened anxious arousal and vigilance, distal responses seek to lower behavioral inhibition and the associated state of anxiety and vigilance through engaging in distal defenses. In the present research, we propose that the reactions to COVID-19 may represent distal defense strategies to the pandemic (in the form of environmental or group related worldview defenses) and therefore can be explained and forecasted by the model. Thus we hypothesized increased perceived COVID-19 threat perception to lead to a proximal threat response in the form of heightened behavioral inhibition. This, in return, should enhance the use of distal defenses (i.e.: several ingroup biases, system justification and conspiratorial beliefs) overlapping with the reactions observed as a response to COVID-19. This hypothesized mediated effect of increased perceived COVID-19 threat on distal defenses was tested in two pre-registered studies: In Study 1 (N = 358) results showed perceived COVID-19 threat to be related to behavioral inhibition and in turn to be associated with increased distal defenses (i.e., higher entitativity, control restoration motivation, passive party support). In Study 2 (N = 348) we manipulated COVID-19 threat salience and found results suggesting the distal defenses of system justification and conspiratorial beliefs to be mediated by the proximal threat response. The results of the present research hint towards a common mechanism through which the seemingly unrelated reactions to COVID-19 can be explained. The results might help to predict future behavior during the COVID-19 pandemic and design measures to counteract detrimental effects of the pandemic. (shrink)

Let intentionalism be the view that what proposition is expressed in context by a sentence containing indexicals depends on the speaker’s intentions. It has recently been argued that intentionalism makes communicative success mysterious and that there are counterexamples to the intentionalist view in the form of cases of mismatch between the intended interpretation and the intuitively correct interpretation. In this paper, I argue that these objections can be met, once we acknowledge that we may distinguish what determines the correct interpretation (...) from the evidence that is available to the audience, as well as from the standards by which we judge whether or not a given interpretation is reasonable. With these distinctions in place, we see that intentionalism does not render communicative success mysterious, and that cases of mismatch between the intended interpretation and the intuitively correct one can easily be accommodated. The distinction is also useful in treating the Humpty Dumpty problem for intentionalism, since it turns out that this can be treated as an extreme special case of mismatch. (shrink)

In this basically expository paper we discuss the role of logic and mathematics in researches concerning the ontology of scientific theories, and we consider the particular case of quantum mechanics. We argue that systems of logic in general, and classical logic in particular, may contribute substantially with the ontology of any theory that has this logic in its base. In the case of quantum mechanics, however, from the point of view of philosophical discussions concerning identity and individuality, those contributions may (...) not be welcome for a specific interpretation, and an alternative system of logic perhaps could be used instead of a classical system. In this sense, we argue that the logic and ontology of a scientific theory may be seen as mutually influencing each other. On the one hand, logic contributes to shape the general features of the ontology of a theory; on the other hand, the theory also puts constraints on the possible understanding of ontology and, respectively, on possible systems of logic that may be the underlying logic of the theory. How does history relate to the past? According to leading historical theorists, the relation to the past in history is reducible to evidential, psychological, practical and retrospective concerns. In contrast, this volume claims that historical relations to the past are irreducible products of the logical commitments of history as method. Ahlskog argues that the method of history shapes and enables relations to past in historical research by invoking past perspectives of meaning for rendering reality intelligible. Nonrelativistic quantum mechanics (QM) works perfectly well for all practical purposes. Once one admits, however, that a successful scientific theory is supposed not only to make predictions but also to tell us a story about the world in which we live, a philosophical problem emerges: in the specific case of QM, it is not possible to associate with the theory a unique scientific image of the world; there are several images. The fact that the theory may be compatible with distinct (...) ontologies, and that those ontologies may themselves be associated with a plurality of metaphysical approaches, gives rise to the problem of metaphysical underdetermination. This paper concludes that the available metametaphysical criteria fail to deliver objectivity in theory choice, and it puts forward its own criterion based on a tension between two methods of metaphysical inquiry: one that is closely related to science and another that is not. Perception purports to help you gain knowledge of the world even if the world is not the way you expected it to be. Perception also purports to be an independent tribunal against which you can test your beliefs. It is natural to think that in order to serve these and other central functions, perceptual representations must not causally depend on your prior beliefs and expectations. In this paper, I clarify and then argue against the natural thought above. All perceptual systems (...) must solve an under-determination problem: the sensory data they receive could be caused by indefinitely many arrangements of distal objects and properties. Using a Bayesian approach to perceptual processing, I argue that in order to solve the under-determination problem, perceptual capacities must rely on prior beliefs or expectations of some kind. I then argue that perceptual states or processes can help ground knowledge of the world whether the ‘beliefs’ necessary for perceptual processing are encoded as sub-personal states within a perceptual system or cognitive states, such as person-level beliefs. My argument has two main parts. First, I give a preliminary argument that cognitive influence on perception can be appropriate, and I respond to three lines of objection. Second, I argue that cognitively influenced perceptual states can be instances of seeing that p, which makes the relevant states well suited to help ground knowledge that p. I conclude that a cognitively penetrated perceptual state or process can help ground knowledge under some circumstances. (shrink)

This paper questions the adequacy of the explicit cancellability test for conversational implicature as it is commonly understood. The standard way of understanding this test relies on two assumptions: first, that that one can test whether a certain content is conversationally implicated, by checking whether that content is cancellable, and second, that a cancellation is successful only if it results in a felicitous utterance. While I accept the first of these assumptions, I reject the second one. I argue that a (...) cancellation can succeed even if it results in an infelicitous utterance, and that unless we take this possibility into account we run the risk of misdiagnosing philosophically significant cases. I propose a pragmatic approach to the kind of reference-shifting occurring in indexicals as used in e.g. written notes and answering machine messages. I proceed in two steps. First, I prepare the ground by showing that the arguments against such a pragmatic approach raised in the recent literature fail. Second, I take a first few steps towards implementing this approach, by sketching a pragmatic theory of reference-shifting, and showing how it can handle cases of the relevant kind. While the immediate (...) scope of the paper is restricted to indexicals and reference-shifting, and the discussion is confined to a specific range of theories and cases, the approach proposed is compatible with a fairly broad range of more or less semantically conservative theories, and many of the conclusions drawn are significant for the evaluation of pragmatic explanations in philosophy more generally. The overall goal is to offer a new perspective on the issues under discussion, and to prompt philosophers to reconsider some of the established methods by which pragmatic explanations are evaluated. Experiences—visual, emotional, or otherwise—play a role in providing us with justification to believe claims about the world. Some accounts of how experiences provide justification emphasize the role of the experiences’ distinctive phenomenology, i.e. ‘what it is like’ to have the experience. Other accounts emphasize the justificatory role to the experiences’ etiology. A number of authors have used cases of cognitively penetrated visual experience to raise an epistemic challenge for theories of perceptual justification that emphasize the justificatory role of phenomenology rather (...) than etiology. Proponents of the challenge argue that cognitively penetrated visual experiences can fail to provide the usual justification because they have improper etiologies. However, extant arguments for the challenge’s key claims are subject to formidable objections. In this paper, I present the challenge’s key claims, raise objections to previous attempts to establish them, and then offer a novel argument in support of the challenge. My argument relies on an analogy between cognitively penetrated visual and emotional experiences. I argue that some emotional experiences fail to provide the relevant justification because of their improper etiologies and conclude that analogous cognitively penetrated visual experiences fail to provide the relevant justification because of their etiologies, as well. Insight is a cognitive feature that is usually regarded as being generated by the neocortex and being present only in humans and possibly some closely related primates. In this essay we show that especially corvids display behavioral skills within the domains of object permanence, episodic memory, theory of mind, and tool use/causal reasoning that are insightful. These similarities between humans and corvids at the behavioral level are probably the result of a convergent evolution. Similarly, the telencephalic structures involved in higher (...) cognitive functions in both species show a high degree of similarity, although the forebrain of birds has no cortex-like lamination. The neural substrate for insight-related cognitive functions in mammals and birds is thus not necessarily based on a laminated cortical structure but can be generated by differently organized forebrains. Hence, neither is insight restricted to mammals, as predicted from a “scala naturae”, nor is the laminated cortex a prerequisite for the highest cognitive functions. (shrink)

According to the communication desideratum (CD), a notion of semantic content must be adequately related to communication. In the recent debate on indexical reference, (CD) has been invoked in arguments against the view that intentions determine the semantic content of indexicals and demonstratives (intentionalism). In this paper, I argue that the interpretations of (CD) that these arguments rely on are questionable, and suggest an alternative interpretation, which is compatible with (strong) intentionalism. Moreover, I suggest an approach that combines elements of (...) intentionalism with other subjectivist approaches, and discuss the role of intuitions in developing and evaluating theories of indexical reference. We discuss the idea that superpositions in quantum mechanics may involve contradictions or contradictory properties. A state of superposition such as the one comprised in the famous Schrödinger’s cat, for instance, is sometimes said to attribute contradictory properties to the cat: being dead and alive at the same time. If that were the case, we would be facing a revolution in logic and science, since we would have one of our greatest scientific achievements showing that real contradictions exist.We analyze that (...) claim by employing the traditional square of opposition.We suggest that it is difficult to make sense of the idea of contradiction in the case of quantum superpositions. From a metaphysical point of view the suggestion also faces obstacles, and we present some of them. (shrink)

During the last couple of decades, several attempts have been made to come up with a theory that can handle the various semantic, logical and philosophical problems raised by the vagueness of natural languages. One of the most influential ideas that have come into fashion in recent years is the idea that vagueness should be analysed as a form of context sensitivity. Such contextualist theories of vagueness have gained some popularity, but many philosophers have remained sceptical of the prospects of (...) finding a tenable contextualist solution to the problems of vagueness. This paper sets out to undermine the view that a commitment to the early modern conception of the mind as immortalized in Ryle’s metaphor of the (Cartesian) ghost in the machine and in Quine’s metaphor of the (Lockean) myth of the museum is required to articulate a defence of the sui generis character of humanistic explanations. These powerful metaphors have not only contributed to undermining the claim for methodological pluralism by caricaturizing the arguments for disunity in the sciences; they have (...) also, and more worryingly, planted red herrings that have diverted attention away from the genuine issues at stake. This paper is an exercise in removing these false clues to reveal what the claim for the autonomy of humanistic explanations really amounts to. (shrink)

This paper concerns how extant theorists of predictive coding conceptualize and explain possible instances of cognitive penetration. §I offers brief clarification of the predictive coding framework and relevant mechanisms, and a brief characterization of cognitive penetration and some challenges that come with defining it. §II develops more precise ways that the predictive coding framework can explain, and of course thereby allow for, genuine top-down causal effects on perceptual experience, of the kind discussed in the context of cognitive penetration. §III develops (...) these insights further with an eye towards tracking one extant criterion for cognitive penetration, namely, that the relevant cognitive effects on perception must be sufficiently direct. Throughout these discussions, we extend the analyses of the predictive coding models, as we know them. So one open question that surfaces is how much of the extended analyses are genuinely just part of the predictive coding models, or something that must be added to them in order to generate these additional explanatory benefits. In §IV, we analyze and criticize a claim made by some theorists of predictive coding, namely, that (interesting) instances of cognitive penetration tend to occur in perceptual circumstances involving substantial noise or uncertainty. It is here that our analysis is most critical. We argue that, when applied, the claim fails to explain (or perhaps even be consistent with) a large range of important and uncontroversially interesting possible cases of cognitive penetration. We conclude with a general speculation about how the recent work on the predictive mind may influence the current dialectic concerning top-down effects on perception. (shrink)

Reality is hierarchically structured, or so proponents of the metaphysical posit of grounding argue. The less fundamental facts obtain in virtue of, or are grounded in, the more fundamental facts. But what exactly is it for one fact to be more fundamental than another? The aim of this paper is to provide a measure of relative fundamentality. I develop and defend an account of the metaphysical hierarchy that assigns to each fact a set of ordinals representing the levels on which (...) it occurs. The account allows one to compare any two facts with respect to their fundamentality and it uses immediate grounding as its sole primitive. In the first section, I will set the stage and point to some shortcomings of a rival account proposed by Karen Bennett. The second section will present my own proposal and the third section will discuss how it can be extended to non-foundationalist settings. The fourth section discusses potential objections. (shrink)

According to Kant each person has an empirical character, which is ultimately grounded in one’s free choice. The popular Causal Laws interpretation of empirical character holds that it consists of the causal laws governing our psychology. I argue that this reading has difficulties explaining moral change, the ‘gradual reformation’ of our empirical character: Causal laws cannot change and hence cannot be gradually reformed. I propose an alternative Causal Powers interpretation of empirical character, where our empirical character consists of our mind’s (...) causal powers. The resulting picture of empirical character allows for moral change and Kantian weakness of will. (shrink)

In the debate over what determines the reference of an indexical expression on a given occasion of use, we can distinguish between two generic positions. According to the first, the reference is determined by internal factors, such as the speaker’s intentions. According to the second, the reference is determined by external factors, like conventions or what a competent and attentive audience would take the reference to be. It has recently been argued that the first position is untenable, since there are (...) cases of mismatch where the intuitively correct reference differs from the one that would be determined by the relevant internal factors. The aim of this paper is to show that, contrary to this line of argument, it is the proponent of the second position that should be worried, since this position yields counterintuitive consequences regarding communicative success in cases of mismatch. How strongly an agent beliefs in a proposition can be represented by her degree of belief in that proposition. According to the orthodox Bayesian picture, an agent's degree of belief is best represented by a single probability function. On an alternative account, an agent’s beliefs are modeled based on a set of probability functions, called imprecise probabilities. Recently, however, imprecise probabilities have come under attack. Adam Elga claims that there is no adequate account of the way they can be manifested (...) in decision-making. In response to Elga, more elaborate accounts of the imprecise framework have been developed. One of them is based on supervaluationism, originally, a semantic approach to vague predicates. Still, Seamus Bradley shows that some of those accounts that solve Elga’s problem, have a more severe defect: they undermine a central motivation for introducing imprecise probabilities in the first place. In this paper, I modify the supervaluationist approach in such a way that it accounts for both Elga’s and Bradley’s challenges to the imprecise framework. (shrink)

In this work, we focus on a very specific case study: assuming that quantum theories deal with “particles” of some kind, what kind of entity can such particles be? One possible answer, the one we shall examine here, is that they are not the usual kind of object found in daily life: individuals. Rather, we follow a suggestion by Erwin Schrödinger, according to which quantum mechanics poses a revolutionary kind of entity: non-individuals. While physics, as a scientific field, is not (...) concerned with whether entities posited by a specific physical theory are individuals or not, answering this question is part of the quest for a better understanding of physical reality. A brain-computer interface technology that can decode the neural signals associated with attempted but unarticulated speech could offer a future efficient means of communication for people with severe motor impairments. Recent demonstrations have validated this approach. Here we assume that it will be possible in future to decode imagined (i.e., attempted but unarticulated) speech in people with severe motor impairments, and we consider the characteristics that could maximize the social utility of a BCI for communication. As a social interaction, communication (...) involves the needs and goals of both speaker and listener, particularly in contexts that have significant potential consequences. We explore three high-consequence legal situations in which neurally-decoded speech could have implications:Testimony, where decoded speech is used as evidence;Consent and Capacity, where it may be used as a means of agency and participation such as consent to medical treatment; andHarm, where such communications may be networked or may cause harm to others. We then illustrate how design choices might impact the social and legal acceptability of these technologies. (shrink)

In the paper we investigate the topos of sheaves on a category of ultrafilters. The category is described with the help of the Rudin-Keisler ordering of ultrafilters. It is shown that the topos is Boolean and two-valued and that the axiom of choice does not hold in it. We prove that the internal logic in the topos does not coincide with that in any of the ultrapowers. We also show that internal set theory, an axiomatic nonstandard set theory, can be (...) modeled in the topos. (shrink)

According to the received view, philosophy of action took a justified turn towards causalism because anti-causalists failed the causalist challenge about efficacious reasons. This paper contests that view by examining the ways in which Georg Henrik von Wright responded to causalism in his later philosophy. First, von Wright attacked the subjectivism of causalism by arguing for an objectivist view that construes reasons not as subjective mental states but as external facts of the agent's situation. Second, von Wright fundamentally disagreed with (...) the view of philosophical inquiry that underpinned causalism. For von Wright, the task of philosophy was conceptual: to explicate what one is looking for when one is looking for the real reasons for action. In contrast, for causalists the task was ontological: to determine what kind of item in the world the real reason for action is. Examining von Wright's account contributes to contemporary assessments of the metaphilosophical dimension of the reasons/causes debate. (shrink)

Is there a pro tanto moral reason to create a life merely because it would be good for the person living it? Proponents of the procreation asymmetry claim there is not. Defending this controversial no reason claim, some have suggested that it is well in line with other phenomena in the moral realm: there is no reason to give a promise merely because one would keep it, and there is no reason to procreate merely to increase the extent of justice (...) in the world. Allegedly, some analogs extend so far as to support a unified theory of the no reason claim and the nonidentity thesis, that is, the view that of two persons leading lives of positive wellbeing, there is a reason to create the person with higher wellbeing. I dismantle the proposed analogs and show that they fail to meet various desiderata. Moreover, I refute Johann Frick's argument that the no reason claim follows from the assumption that reasons of beneficence are reasons to act for the sake of people. By criticizing attractive defenses for the no reason claim, I weaken its plausibility. (shrink)
